Kim Parker Achieves Victory in Reversal of Default Judgment
Baltimore County, MD – Kim Parker has successfully reversed a Default Judgment against her client, in a case originating in the Circuit Court for Baltimore County. The appellate court ruled in favor of the client, determining that the trial court erred in entering an Order of Default against her despite her timely response to the complaint.
The case stemmed from a civil action initiated by Peter M. Ferraro, a landlord and property manager known for his involvement in local real estate disputes. Ferraro claimed that the client owed him unpaid rent and damages for his property. However, evidence uncovered during the litigation revealed that Mr. Ferraro had been attempting to collect money related to a property that he did not yet own, a practice that is prohibited under Maryland law.
In addressing the appeal, the appellate court found that the client submission on January 13, 2021, constituted a valid answer to the complaint, effectively negating the grounds for a default judgment. The court highlighted that the initial default order and subsequent judgment should not have been granted as the client had never been in default.
